As we look back and reflect on our compliance programs during Compliance Week 2025, it is a good time for us here at The Bonadio Group to share some of our top findings over the course of the year.
You cannot use a “set it and forget it” mentality when trying to maintain an Effective Compliance Program. You have to constantly assess and reassess your programs and update and personalize based on your individual organization’s risks and needs. Utilizing your own internal findings as well as what is going on in the wider community is essential to an effective Compliance Program.
Here are our top findings over the last year (not in any specific order):
- Self-Disclosure protocols not being followed
- Exclusion screening not being completed every 30 days
- Internal auditing and monitoring not completed consistently
- Compliance Program Effectiveness Reviews lacking defined methodology
- Training does not include section for billing and documentation
- Annual Compliance Policies and Procedures review does not include an assessment of effectiveness or an assessment if staff are following the P&Ps
- Compliance Documents not found on website
- Compliance Hotline not tested
- Still do not have a fully implemented Compliance Program
- Corrective Actions not put in place
Other key areas identified:
- HIPAA Privacy Officer and HIPAA Security Officer not officially named
- Contracts not audited
- Organization-wide Compliance Program not implemented
Now is a good time to determine how the current regulatory environment has affected you, your roles and responsibilities, and your organization. When reviewing Federal, State and local laws, rules and regulations, consider what additional resources, if any, you need to maintain an effective Compliance Program and remain compliant. Educate your Senior Leadership and Board and be diligent in reviewing your organization’s current Compliance Program. Compare your Compliance Program to current information at hand, both internal and external, and develop a plan to make any necessary changes and implement them ASAP.
